Just to stop the argument before it starts, two things:
1. Given that we don't really know exactly how the spell works and how much of it was the spell and exactly what Twilight did to reverse it, the whole line between "the spell did the ascension" and "something else did it" is kinda blurry. The most certain thing we can say is that the spell was part of the sequence of events that lead to Twilight's ascension. Whether the spell specifically was required or whether Twilight could theoretically could've ascended via a different set of circumstances is unknown.
2. We honestly don't know enough about how ascension even works to extrapolate anything given that our sample size is two. We have no clue whether each alicorn ascends differently, or if they're all the same.

Funny you should say it's the government, because that's one of the few things that isn't copyrighted. In most cases, everything produced officially by the US government is Public Domain.

Of course, they can't go after everyone who uses it in public or in private, so they don't bother on that front.

Because there are a variety of methods, yeah, but there's still the strong implication that Cadence's ascension was triggered - though I haven't read the book, I do recall there being mention to some sort of artefact. Even if we do assume that it was triggered by the act of kindness for the villain of the story, what does that mean for Celestia and Luna? Their respective ascensions were triggered by an act of great sun and moon?
While the nature of the action involved likely has a say in the resultant aspect, all signs point to the fact that something needs to be done to trigger ascension in the first place. Some kind of enormous magical gathering, or artefact, or possibly even someone with a strong connection to something just up and dying and coming back to life. But there's no real reason to think that Twilight ascended just because she was a really good friend, or particularly philosophical.
