Thing is we don't even know if this was from Hasbro themselves, since the C&D came from an outside law firm, not from their legal department like all the rest have.
And the issue isn't that if they don't protect it, they automatically lose it, it's if they don't appear to be protecting it, someone can come along, blatantly rip them off, and win in court, voiding their trademark, if they can show Hasbro has a habit of not enforcing it.
So yeah the biggest issue is the fucking cluster fuck of IP and trademark law.

Dakota's blog An odd agent of justiceNo, the notice is legit it seems, the law firm does have the right from Hasbro to do this as far as anyone can tell.
BUT, it might just be the law firm itself was contracted by Hasbro to go after some of the knock-off toy's that some companies are making. Or other such things, and the law firm got overzealous and started attacking things Hasbro didn't intend to be C&D'd.
Or anyher case of their legal department acting on it's own without the rest knowing about.
the Hasbro VP in charge of MLP has no clue what's going on and is actually trying to get some answers for us.

Hasbro's a TOY COMPANY! It can't be both, or else, it would be like Microsoft.
@Kix: Again, Hasbro isn't a unified entity. It has dozens of subsections, and a lot of the time the right hand doesn't know what the left hand is doing. Heck, we know for a fact that the VP of Hasbro Studios wasn't aware of the C&D. What most likely happened is that Hasbro farmed out some of legal work to a third party, who then started going after targets that the company itself probably wouldn't mind. Either that or certain departments ordered the C&D without telling the others. It's entirely possible that the entire thing is the result of one person stumbling across Jan's Youtube channel and deciding to put the kibosh on it.

So simply, they just didn't know. So why didn't they just keep an eye out and see it for themselves? That would save a lot of problems because then they would know how to handle it so everyone is happy.
