x4 Except you kind of need to do villainous things to be considered a villain; that's why it's called villain. Whis did absolutely nothing villainous beyond being a chauffeur for Beerus and eating food in the background, so by no sane definition of villain does Whis fit.

No. He goaded 18 and 16 into not interfering by daring 17 to fight him by himself. Plus, 16 probably wouldn't have done anything since he only wanted to fight Goku, and since 18 is a little weaker then 17, she likely couldn't have beaten Piccolo.
So his real mistake was not beating up the weaker 18 (and why exactly is she weaker, beyond a Hand Wave of Gero thought it'd make her easier to control?).
Oh well. It's not like the fight had any point beyond help Cell find the Androids.

Also, 17 would've eventually won, but he's pretty damn cocky. I think that Piccolo's ultimate move would severely damage or outright kill him, if he decide to face-tank it.
That said, he's not stupid enough to try that : DBZ characters are not suicidal, if the move is dangerous, he's going to try to do something.

You can say "but he didn't do anything" as much as you want, but it does not change the fact that he was part of the 'team' of the villains. He's not particularly evil, but you don't need to be super evil in order to be a villain. Because as much as you keep saying 'well he needs to do something villainous', you can't change the fact that he did, simply by setting Beerus loose on Earth. He could've always stopped Beerus with a chop to the back of the neck whenever he wanted.
Whis is a movie villain.
Is he evil?
Not really, he's apathetic at worst.
But he's still one of the two villains of the movie.

@Hardcorefakes: Except destroying the time machine was one of the first things Black did. The one they were using now was Cell's and this episode was the only time he actually had the opportunity to destroy it.

Well, unless Piccolo tried the last ditch effort on him that he used on Cell (Light Grenade) 17 would have won by sheer virtue of being able to continue forever while Piccolo couldn't. And even with Light Grenade, there's no guarantee 17 couldn't just dodge it or his shield wouldn't be able to withstand it.
