In a setting where you reap profit from it, yes - the copyright is currently owned by Warner. You're supposed to pay, like $700 in royalties per use or something.

Officially, it's Warner/Chappell Music, part of Warner Music Group. They bought it for, like, $25 million. They also own "Winter Wonderland".

I think MJ wrote the other famous version of the birthday song, the one that goes "Today is your birthday/Happy birthday to you"

That, and it is the copyright holder's responsibility to enforce their copyright at their own cost. With so many people technically violating it, it would be more costly for Warner to enforce every single instance than it would be worth.
