Welcome to the main discussion thread for the Marvel Cinematic Universe! This pinned post is here to establish some basic guidelines. All of the Media Forum rules still apply.

  • This thread is for talking about the live-action films, TV shows, animated works, and related content that use the Marvel brand, currently owned by Disney.
  • While mild digressions are okay, discussion of the comic books should go in this thread. Extended digressions may be thumped as off-topic.
  • Spoilers for new releases should not be discussed without spoiler tagging for at least two weeks. Rather, each title should have a dedicated thread where that sort of conversation is held. We can mention new releases in a general sense, but please be courteous to people who don't want to be spoiled.

If you're posting tagged spoilers, make sure that the film or series is clearly identified outside the spoiler tagging. People need to know what will be spoiled before they choose to read the post.

Since Thor and now Captain America came out this year, I wanted to get what Tropers thought of the concept and execution of the Marvel Cinematic Universe in general. Personally I love the idea and wonder why this idea hasn't been seriously tried before. It sorta seems to me like the DCAU in movie form (And well, ummm, with Marvel), and really 'gets' the comic book feel of a shared universe while not being completely alienating.

Ok i saw a little bit of endgame and I dont know what is more ballsy: that Cap said "hail hydra" or him saying he is ass of america.

Also, saying you are from hydra, using crossbone tactic against yourself....you have kinda change a lot in years, not steve?.

Well, going through the whole Civil War storyline kind of knocked a bit of the idealist out of him. He matured, isn't as averse to fighting dirty when need be, and it definitely seems like being constantly surrounded by Deadpan Snarkers has rubbed off on him.

Knowing Ultron, im surprise he didnt mock Tony for nearly chocking her in Iron man 3, but them again Tony devolpment is kinda wonky taking Iron man 3 into acount.

Um... wut?

When did Tony nearly choke Pepper in Iron Man 3? I don't remember that part of the movie. Did I miss something?

Are you talking about when Tony's suit comes online while he's asleep and nearly attacks them? Because, that's not exactly the same thing as Domestic Abuse.

So I have a question.

Those alternate identities Peter used when Norman tried to frame Spider-Man for murder.

Do those count as Spider-Man characters? Because if not, I think we've found our loophole.

-what did I just miss.

[up] Easiest solution still seems to be putting Holland in a blond wig and calling the movie "Scarlet Spider." I don't think the contract covers doppel-Spiders.

[up][up] and [up] Yes, they do.

The contract with Sony is extremely specific and lists one character various times but with different pseudonyms.

They still fall under the umbrella of Spider-Man. Click the link and then click the link to the contract (couldn't copy it from mobile because it would automatically download it) and you'll see that those characters also fall under Sony.

In fact, a while ago, Sony announced that they were working on a Dusk movie, who was one of the identities that Peter used but later inherited to Cassie.

I don't think the contract covers doppel-Spiders.

It definitely does. They're derivative characters from the same IP. If it didn't, that'd be like WB being able to make a Batman movie but somehow not being allowed to use Robin or Batgirl.

Probably for the same reason she was created in the first place.

She (and She-Hulk) were created after the licensed Hulk and Spider-Man for tv shows. However, those agreements stipulated that if the networks wanted to make a female centric spin-off of them, then the network would keep the rights of those characters. So Marvel created both She-Hulk and Spider-Woman as a safety that the networks wouldn't create female equivalents.

I imagine that since Spider-Woman is a name easily related to Spider-Man, she was included in the contract in order to prevent a rival company to make a competing movie that the audiences could think is related to the main hero and their franchise.

She's similar to the Quicksilver and Scarlet Witch fiasco. She was ostensibly created as a Spin-Off character of Spider-Man for the trademark reasons mentioned above, but other than the name and costume she had very little to do with him for the vast majority of her existence, and since 2005 or so has been way more closely tied to the Avengers franchise than anything else.

Okay but... we can have a Venom movie that somehow doesn't allow for Spider Man?

Sony has the film rights to the Spider-Man franchise, of which Venom is a part. Venom didn't feature Spider-Man because they chose not to use him (seemingly in some sort of vain hope that they'd get to cross over with the MCU eventually), not because they were somehow legally barred from doing so. Sony makes all the Spider-Man films, including the spin-offs.

Dunno why people aren't mentioning merchandising rights which is massive and more profitable.

[up][up][up] That's actually a good question. Now, the joke that Peter could still appear, just in the identity of Night Monkey? That's never going to fly.

But does Marvel actually own the rights to the concept of a hero called Night Monkey? Granted, it's just a Running Gag in the film, so nobody probably thought about who owns the rights. But if Marvel were to release a comic about a hero in Europe called Night Monkey, unrelated to Spider-Man, would that cause any legal trouble?

If Sony owns the rights to any characters created specifically created for their MCU Spidey films, then there's precedent there that they would own the film rights for Night Monkey. But they might not own the rights to anything the comics made up, like his supporting cast or villains. I guess he would exist in this weird limbo territory like a lot of Canon Foreigner Marvel characters. There's a reason you don't see someone like the Gamma Ray in the comics.

Dunno why people aren't mentioning merchandising rights which is massive and more profitable.
Mainly because Sony already sold the merchandising rights to Disney for "a one-time payment of $175 million to Sony and paying up to $35 million for each future Spider-Man film rather than receiving their previous 5% of a Spider-Man film's revenue—Marvel could now reduce their $35 million payment if the co-produced film grossed more than $750 million."

For those who want to know more about the deal, read this:

Sony Pictures Entertainment paid for the $175 million production of the movie, including the writing, shooting, and editing, but that entire process was managed by Walt Disney Co.

Sony will keep all of the profits “Homecoming” generates following its release on July 7. Disney controls all merchandise rights to the character and is betting that a hit movie will result in millions more Spider-Man toys and bed sheets flying off shelves.

So the original agreement (made in the '90s) was that Marvel would get 5% of the revenue and split the profits from merchandising with Sony, but the 2011 agreement meant that Marvel wouldn't get any revenue from the films, but instead get 100% of the profits of merchandising. Plus, Disney would then pay Sony for $35 million per film — but, since Marvel agreed to make the films with Sony, they agreed that the $35 million would be reduced if the movie made more than $750 million.
