- Spoilers for new releases should not be discussed without spoiler tagging for at least two weeks. Rather, each title should have a dedicated thread where that sort of conversation is held. We can mention new releases in a general sense, but please be courteous to people who don't want to be spoiled.
If you're posting tagged spoilers, make sure that the film or series is clearly identified outside the spoiler tagging. People need to know what will be spoiled before they choose to read the post.

That's not how that works! Marvel already had Quicksilver and Scarlet Witch because they're technically Avengers characters with X-Men-y origins. Wolverine's been on the Avengers a few times but he's mostly an X-Guy.
I think the delineation is how often they were associated with either group. Quicksilver and Scarlet Witch were associated with the Avengers from pretty early on - they joined in the '60s. Wolverine joined in 2004, I believe.
The fact that Quicksilver and Scarlet Witch were also mutants and became more associated with Magneto meant that Disney and Fox could work out a deal to share them (although, considering Quicksilver died, I don't think they actually wanted to share them that much).
We've never been given an official word on the subject but I'm 1000 percent (yes 1000) certain that it is not "Marvel got them by changing their origin."
That isn't going to mean anything to a judge. If Marvel went to court tomorrow with a proposal saying that in the new Avengers movie Jean Grey is Star-Lord's sister who got powers from the Mind Stone and Storm is a Wakandan genetic experiment, that wouldn't magically change the fact that they are X-Men characters and have been for the entirety of their published existences.

They don't even need Jean Grey.
Wanda is basically Jean. Use Cthon for the Phoenix Force and you can basically do all the same strokes.
