The General US Politics Thread

Go To

Nov 2023 Mod notice:

There may be other, more specific, threads about some aspects of US politics, but this one tends to act as a hub for all sorts of related news and information, so it's usually one of the busiest OTC threads.

If you're new to OTC, it's worth reading the Introduction to On-Topic Conversations and the On-Topic Conversations debate guidelines before posting here.

Rumor-based, fear-mongering and/or inflammatory statements that damage the quality of the thread will be thumped. Off-topic posts will also be thumped. Repeat offenders may be suspended.

If time spent moderating this thread remains a distraction from moderation of the wiki itself, the thread will need to be locked. We want to avoid that, so please follow the forum rules when posting here.

In line with the general forum rules, 'gravedancing' is prohibited here. If you're celebrating someone's death or hoping that they die, your post will get thumped. This rule applies regardless of what the person you're discussing has said or done.

Seriously, I think the Trump Administration is using them as hostages so the idea of just bailing them out of a threat to their power.

They won't want to release them.

@ Trump's Hostages;

Yeah. There's no way the administration will actually let the kids go. No matter how much pressure builds up against them.

I wouldn't be surprised at all if this was the result of a group of men meeting to discuss the fate of children and their parents over cake and coffee.

They're open about the fact they do not care. They don't want anyone else to.

Which would be a nice icing on the cake.

Reading that survey mentioned a while ago, while this one is still horrendously biased, it's not quite as bad as some of the others. For example, this one actually gives you the option to answer some of the questions on a binary. Some other surveys have been so atrociously written that it's actually impossible to give any answer contrary to their confirmation bias.

Oh, here's the RAICES FAQ on the bailout.

Who is this fundraiser for?

This fundraiser is for The Refugee and Immigrant Center for Education and Legal Services (RAICES). RAICES is the largest immigration legal services non-profit in TX, focusing on under-served immigrant children, families and refugees. From their Facebook page: “RAICES is an organization that serves immigrants and refugees in our community by providing immigration-related legal services, advocacy and opportunities for educational and social support. We believe that by actively promoting the well-being and informed participation of immigrants and refugees in the community, everyone benefits.” Their Facebook page is here: https://www.facebook.com/raicestexas/ and their website is https://www.raicestexas.org/

Charlotte and Dave created this fundraiser (backstory here) through the Facebook Fundraiser feature. Donations made through this Facebook feature go directly to the organization. Charlotte and Dave aren’t affiliated with RAICES and won’t see a penny of it and neither will Facebook! Facebook collects no fees on donations that are processed through the site using the Fundraiser feature. You can learn more about it through their Help links on the side of the fundraiser page or in the Help Center: https://www.facebook.com/help/356680401435429/?helpref=hc_fnav

How are the donations going to be used?

“The funds will go toward legal representation for immigrant children and parents in Texas, as well as toward paying parents’ bond so they can be released from detention centers and reunited with their children. The organization — which currently has about 50 lawyers on staff — plans to go on a hiring spree and fund training for volunteer lawyers willing to travel to Texas to assist, Mr. Ryan said.” - https://www.nytimes.com/2018/06/19/us/raices-charity-border-immigrants.html

RAICES has two big projects they are fundraising for right now (from their website):

LEAF - The Legal Representation, Advocacy, and Education (LEAF) Project will provide universal representation for released unaccompanied kids in Texas. Simply, children are being taken from their families, put into a system not equipped to ensure their safety, and losing the representation designed to be their safeguard through this process. Last year, 76% of kids in immigration court in Texas were not represented. That’s over 13,000 children without legal help. This fund will guarantee legal representation for children so they do not have to do this alone. Family Reunification and Bond Fund: FREE our Families - Parents separated from their children at the border (and other immigrants placed in detention) can't get released from ICE custody to reunite with their families until they pay the full amount of their immigration bond. Bonds are set at a MINIMUM of $1500, and are usually in the range of $5-10K, even for asylum seekers without any criminal history. This fund will directly support legal services for detained separated parents and the direct funding for bonds to get parents released.

Here’s another helpful link with more information about how RAICES can be effective with your generosity: https://slate.com/business/2018/06/raices-can-be-effective-with-all-that-money-its-raising-on-facebook.html

Can RAICES use all this money?

The short answer is: yes.

In the most generous interpretation of the stories coming to light, U.S. Border Patrol and the Department of Health and Human Services are *abjectly terrible* at their jobs. In the more likely interpretation: they don't particularly care about reuniting these families. Regardless of motivation, the result is the same: the government of the United States is actively preventing these families from being made whole.

RAICES and the organizations they are partnering with are going to need a lot more than a bond fund. They're going to need a lot more than a few pro bono attorneys. They need a legion of lawyers, psychologists, child advocates, investigators. They need you calling your elected officials EVERY. SINGLE. DAY. about this. They need you talking to everyone you know about this. And they will need it for a very long haul.

After you're done reading this story — please commit to this cause. Share it with your Facebook friends. Talk about it at the dentist and in the grocery checkout line. Bring it to church and synagogue and mosque and any other temple of values and morals in your life. Google incessantly for your local charities that work with the Office of Refugee Resettlement and sign up to help tomorrow. Let every day of your life be a day where you have remembered these families and done something about it.

These kids have to be more than a moment for us — they have to be a movement. The only people who can fix this are the people of the United States of America.

I think those who are comparing the internment of illegal immigrants to Nazi policies are looking too far afield. There is a dark spot in our history with much more similarity, namely the Japanese internment camps during WWII.

Donald Trump May Not Be on the 2020 Election Ballot in Some States Unless He Releases His Tax Returns

The Rhode Island Senate on Tuesday passed a bill that would require all presidential candidates to make their tax returns from the past five years available for voters to see, or risk being left out at the polls. Lawmakers approved of the bill overwhelmingly, 34 to 3. The legislation will now move on to the statehouse for a vote.

The Democrats who run Rhode Island's state Senate told The Providence Journal that “tax returns provide essential information about candidates’ conflicts of interest, and other vital information to a voter weighing a decision."

Rhode Island is not the only state passing this kind of legislation. In early May, Maryland lawmakers passed a similar bill that would force presidential candidates to publicize their tax returns in order to appear on the state ballot.

Day 519: Phony stories.

1/ Paul Ryan abruptly delayed a vote on a "compromise" immigration package until next week, as Republicans search for a way to get 218 votes to pass the measure. The bill that would provide $25 billion for Trump's border wall, offer a pathway to citizenship for Dreamers, and keep migrant families together in detention centers. It was the second time the bill has been delayed this week. (Politico / Washington Post / New York Times)

2/ Trump told Republicans to "stop wasting their time on Immigration" until after the midterms, predicting that more Republicans will be elected to Congress, and accusing Democrats of creating "phony stories of sadness and grief" on the border. Three days ago, Trump tweeted that "now is the best opportunity ever for Congress to change the ridiculous and obsolete laws on immigration." Trump's comments came shortly after Republican House leaders postponed a vote on a broad immigration bill. (NBC News / Washington Post)

4/ The Pentagon will house up to 20,000 unaccompanied migrant children at military bases "for occupancy as early as July through December 31, 2018." The Navy is also preparing plans to construct "temporary and austere" tent cities to house 25,000 migrants at abandoned airfields in Florida and Alabama. The proposed plans also call for camps near San Francisco and at Camp Pendleton along the Southern California coast that would hold as many as 47,000 people each. 5/ National Enquirer executives regularly sent Michael Cohen copies of stories about Trump in advance of publication during the 2016 presidential campaign. The company denied the practice, but three sources say it continued even after Trump took office. If "a story specifically about Trump," one person said, "then it was sent over to Michael, and as long as there were no objections from him, the story could be published." the Supreme Court just ruled that 5-4 that cell phone location data is protected by the Fourth Amendment. Here's a good explainer from Renato Marriotti.

1/ Today the Supreme Court issued an extraordinarily important decision that will have major implications for law enforcement. In Carpenter, a 5-4 majority concluded that law enforcement needed a warrant to obtain 127 days of historical cell cite records:

2/ Historical cell cite records are generated by your cell phone provider when your phone connects with a cell tower to make or take a call. They indicate which tower your cell phone used, which is usually the nearest tower. They often indicate what side of the tower you used.

3/ Historical cell site records provide rough location information for a phone. If a phone uses a tower in north side of Chicago, the phone was located there, not in Milwaukee or New York (or the south side of Chicago). The data isn’t precise enough to tell its exact location.

4/ Law enforcement uses historical cell site data to find out who committed crimes and help prove their guilt. For instance, I used cell site data to track the Bogdanovs as they moved across the country stealing goods:

5/ The data is also used to find crime victims. Unlike active GPS data (which is more precise), cell site data is available if a phone is turned off. It also tells you where the phone was in the *past*, not the present or the future.

6/ For years there has been a debate about what level of court order the government needed to obtain cell site info. Typically they sought a court order under a standard less than a search warrant, which requires “probable cause” the phone would provide evidence of a crime.

7/ Some people thought cell site info had a low standard of protection under the Fourth Amendment, which protects against unreasonable searches. because the info was sent by the person’s phone to the phone company.

8/ Typically information that is sent to a third party, like call records or bank records, gets low protection. Also cell site info typically shows locations while the phone is in public. Typically your location in a public place receives low protection.

9/ After all, law enforcement could just conduct surveillance and see where you’re at. So today’s opinion is the first major attempt by the Supreme Court to alter these standards in the face of new technology that makes it easier for the government to locate you.

10/ The court’s opinion is cautious and narrow but it will have a major impact. I expect the DOJ to always seek warrants for cell site information going forward. That could mean that they won’t get the info in some cases, but shouldn’t effect most cases.

11/ It’s worth noting that if there is a true emergency, law enforcement can get the information without a warrant and then get a warrant later. When I investigated kidnappings in progress, we would obtain information from the phone company and then I’d work on the warrant after.

12/ What is most important about this decision from a legal perspective is the direction it takes the law as to other technologies that track movement and/or involve information sent to a third party, such as more precise electronic location tools used by law enforcement. /end
