One thing we might reasonably change, even with current politics, is getting rid of "golden parachutes". Or at least make it so that the people who make bad long-term decisions are effected by those decisions.
Doesn't solve the investor issue (most still want their return ASAP), but might make the people at the top are more responsible.

That completely goes against everything I know about human behavior. You aren't supposed to be given positive incentives to perform negative behavior. You punish negative behavior such as failure, not reward it.

I know, but one could argue that a wiretapping warrant on someone would count as "making more restrictive", rather than the reverse. And by allowing access to data seized before the warrant, it's retroactive.
Granted, that would be quite a long shot.

He ultimately decided against the law, though he appears to have been sympathetic in the middle of the trial.
Either, A, he was trying to vote party-line but had a random attack of honesty when it came time to vote, or B, he was making a decision based on his own internal logic. B is more likely; Scalia has a tendency to consider odd facts and combine them in odd ways.

Because businesses collapse from the bottom up. Those people at the top scooping in all those short-term profits are usually parachuting out by the time their financial issues hit that high.
Then you just have all the bankruptcy stuck to the business itself (which is a person LOL) as everyone at the bottom gets laid off, while the people who drove it there run off with all its dying earnings.
