There may be other, more specific, threads about some aspects of US politics, but this one tends to act as a hub for all sorts of related news and information, so it's usually one of the busiest OTC threads.

If you're new to OTC, it's worth reading the Introduction to On-Topic Conversations and the On-Topic Conversations debate guidelines before posting here.

Rumor-based, fear-mongering and/or inflammatory statements that damage the quality of the thread will be thumped. Off-topic posts will also be thumped. Repeat offenders may be suspended.

If time spent moderating this thread remains a distraction from moderation of the wiki itself, the thread will need to be locked. We want to avoid that, so please follow the forum rules when posting here.

Would you rather have people from other countries say stuff like "good riddance" or "serves them right"?

Instead of focusing on relatives that divide us, we should find the absolutes that tie us.

I heard she grouped Brown vs. Board of Education in that category, too, but haven't been able to independently confirm it.

She's a fanatic, a walking case study of the politicized hacks that form a large bloc in the judiciary (most but not all on them on the right).

Politics is the skilled use of blunt objects.

Here's her Scholarship Paper where she argues Brown V. Board, Social Security, and West Virginia would be Unconstitutional by a strict Originalist Interpretation.

To be fair to her, she does say trying to reverse course of these decisions would be improper and impractical... But Abortion, Gay Rights, and Health Care aren't among them.

Look, I won't deny that Islamic countries tend to have issues with Women/LGTB rights to name a few, but you have to tackle this carefully or you are going to end up poisoning the cause.

If I recall correctly, the return to social conservationism in the Middle East is tied with resentment against the West over the Cold War and stuff like the Treaty of Sevres.

Instead of focusing on relatives that divide us, we should find the absolutes that tie us.

I'm feeling a sense of deja vu. Didn't Obama try to get someone on the Supreme Court at the eleventh hour, but was blocked by the GOP? How come the Dems can't do that now?

[up][up][up][up] I think you're talking about Merrick Garland, nominated by Obama after Justice Scalia died. Republicans could block the appointment, even refuse to have a vote, because they held the Senate. Democrats don't, at the moment.

Given how utterly stupid originalist interpretations tend to be, holding them should be a disqualifying reason to be a judge.

"I'm going to project my biases on long-dead legislators and claim this is exactly what they meant like it gives my legal opinion greater standing" is ridiculous. It's an abdication of wanting to think about legal decisions.

That would explain things. So how long does it take to properly finish the whole putting-someone-on-a-supreme-court-seat process? Like, the stage at which it is now declared that ACB is on the court, that's it, no backsies?

The inherent stupidity in an originalist approach rears its head when you consider that the entire basis of the Supreme Court being able to strike down laws as unconstitutional arises from... a Supreme Court decision. Where the defendant was James Madison (Jefferson's Secretary of State at the time).

Because when the court's authority is directly affirmed by deciding a case against one of the most important people in writing the damn constitution, it's clear that their intent is not an important factor.

[up][up] Dems can't do anything. They. Do. Not. Control. The. Senate.

If they win the Senate in the election, then they can do something. Until then, going around shouting something like "WE'RE GOING TO PACK THE COURT" is only going to make it more likely they do not get the Senate majority.

@Memers: Now this is pure gold: what, exactly, are they supposed to do?

They don't have the numbers to block the nomination in the Senate, and last I checked Biden isn't the President yet.

Honestly, even if it's not realistic, I'd rather they just not say anything — or at least keep whatever they had to say to themselves.
