NPR is saying that Biden spoke the most during the debate, followed by Harris. And both spoke more than any candidate in both debate nights.

[up] Of course Biden spoke more, he got 30 seconds every time someone else called him out. Which was constantly.

Now, the breakdown of how much of his time was spent defending himself vs. answering the moderators' questions (ie actually promoting himself) would be more interesting. I'd wager he actually spent less time answering questions than at least Harris (especially factoring Harris' ...And That Little Girl Was Me that took at least two minutes when she was supposed to have 30 seconds).

Yeah, that's as disingenuous as Biden going "yeah, Trump's the problem, there's no issue with the fact that people elected him/a party giving him their full support."

[down] There are countries where I'd have been killed for half the things I've said about the president. An elderly Democrat saying that Russia interfered honestly isn't that big in the grand scheme of things. No one who doesn't already believe in Russian interference is going to be convinced of it by that.

Sure but the line has now been drawn that Trump is not a legitimate president, a former president saying that the current president isn’t legitimate is huge, there are countries where this would be the start of a civil war.

[up] Carter didn’t say that Trump is the only problem, he was asked about Russian meddling and said that Trump didn’t legitimately get elected. It certainly comes across in the video like he’s alleging something more direct than just propaganda.

📌 Day 889: The Supreme Court blocked the citizenship question from being added to the 2020 census. The court found that while the Department of Commerce had a right to reinstate the question, the administration provided a "contrived" justification for doing so. The Trump administration claimed the citizenship question was necessary to better comply with federal voting rights law, while critics argued it is an attempt to intimidate immigrant households. Of all the things Trump has questionable ability to do with Executive Orders, this is absolutely one he does not have any power over. He can't change Taxes, only Congress can. This one would be destroyed by even the most Conservative of Courts.

By that logic we’ll also see Trump’s emergency declaration struck down, that’s got me thinking actually, I wonder if a democrat president could declare inequality a national emergency.

Also I wouldn’t put it past the courts to declare that a president can lower taxes by executive order but not increase them.

Just remember, the court can do what it wants, it doesn’t have to be consistent. It let Bush get away with certain stuff that Obama could not get away with. I could definitely see them permitting Trump to pull some tax nonsense, and then overturning the exact same action from a Democratic president.

The checks and balances in our government are only so strong as our elected/appointed officials' willingness to enforce them.

That's one of the biggest takeaways from the Trump Presidency: the failure to outline specific penalties for rule violations is a major flaw of our Constitution. Trump has repeatedly gone beyond the alloted power of his office with zero consequence because Congress and Congress alone is responsible for enforcing those restrictions.

Trump's now indicating that he wants to delay the census until he gets the okay to put the citizenship question on it. Constitutionally, he can't do that. But with a Republican majority in the Senate, Trump can legally wipe his ass with the Constitution whenever he pleases. The only true Constitutionally-outlined limit on his power, after all, lies in Congress's willingness to impeach.

So we'll see.

Double post, because we've got the first impactful fallout from the debates - one of his top fundraisers just abandoned ship.

Tom Mc Inerney, a San Francisco-based attorney who was a lead bundler for former President Barack Obama, told CNBC he informed Biden's team of his decision on June 20.

The news of his break comes one day after Biden delivered an uneven debate performance that provoked new doubts about his candidacy and turned a spotlight back on his controversial statements and past policy positions on civil rights and abortion.

“I had actually let the campaign know I’d pulled back my support of Biden for now,” Mc Inerney told the cable network, adding, “I don’t think he did well last night."

And in a potentially troubling sign for Biden, Mc Inerny predicted that others were likely souring on the Democratic front-runner. “I would imagine I’m not alone,” he said.

Sure but nobody can force the census to happen, maybe a few governors could order their own state census and then redistrict themselves based on that, but without impeachment there’s no way to force Trump to follow the constitution.

The only remedy would be either the House holding non-Trump people in contempt for following Trump’s order or a state starting arresting people for following Trump’s illegal orders.

I don’t see even California arresting members of the census bureau for following illegal orders, if they were going to arresting people for following Trump’s criminal orders they’d be arrest the concentration camp guards.

Yes, and a counter reminder that the court's power is entirely derived from its legitimacy in the eyes of the public. And that legitimacy is currently rested in the false idea that they're nonpartisan.

No one will think they're nonpartisan if they clearly and unambigiously apply one standard to Republicans and another to Democrats.

I don’t see even California arresting members of the census bureau for following illegal orders, if they were going to arresting people for following Trump’s criminal orders they’d be arrest the concentration camp guards.
