Which is what Trump is doing, that's the entire point of precedent. At the moment issuing an executive order is not in the same as declaring a state of emergency, but if Trump uses it to fund the wall there is no reason to assume that Democrats aren't going to use that precedent.
They have to or else their power will be gone. If Republicans are allowed to circumvent Congress whenever they want without consequences then they'll keep doing it, and Democrats know that.

We can either amend the law to restrict further abuses of power or the country will be continually in a state of emergency, where the rule of law is overridden by the rule of whoever our Supreme Leader happens to be. (Just kidding, we're been here for a while but not many people have noticed.)
I'll be honest here, if the democrats manage the 'restrict further abuses of power' route, in my mind it will be a pretty good reason to vote for them. However, given their past track record, I don't see any reason to trust that they will.

@Soban: A civil war between Trump supporters on their power scooters waving canes at millenials and the alt-right who will inevitably back down from a real fight doesnt sound so bad to me. But there would be no civil war or unrest, I see it far more likely that there would be a rise of right wing terrorism supported by some Conservative Christians.
Well the ACLU is suing him so it'll be hitting the courts... now.
And considering that Trump said that there isn't actually an emergency and he's just doing it because it's faster I think he's going to have a bad time.

I just realized that I don't think Trump ever recovered from his time in the WWE.
