Thing is Kennedy and Roberts may switch and vote against the ban. Kennedy is a wild card, and Roberts cares alot about his personal reputation, the power of the court, and making "bold historical pronouncements." note Thomas somehow combines an anti-federal power with an all power to the President philosophy. Alito, I recall one opinion from him ever. I can't tell...
