Certain EULA clauses can be found not to be binding. It's part of contract law; as far as most first world legal systems go, you can't enforce a contract that involves doing things that are illegal.
But again, it's not cut and dried an IANAL, so I'm probably going to shut up now. Yeah the guy was an idiot for not using the safe system. But I still don't like the implications.

Or similarly involve CCP as an entity in such a case. The legal system doesn't take "the defendant was an idiot" as an excuse.
When you have RL money involved, you're walking a fine (and very blurry) line between the rules of internet spaceships and the rules of Real Life that frown on the sorts of things you can get away with doing in internet spaceships.
