We can't use it. We didn't pay for it or ask the artist's permission.
That's the problem with the non-media examples. They are complete works in and of themselves and thus don't fall under fair use.

Infinite Tree: an experimental storyIf the work is on an artist's webpage somewhere, like on a Deviant ART page or an actual works site, then they're generally under copyright and we'd have to get permission to use them. If they're floating around the aether, then I'd say we're good to go. I'm no expert on fair use, though, so don't take that for law.

Well then, that's something that should be changed about image pickin so as to prevent this kind of thing in the future. Should a new thread be made about it?
Here's an alternative which I made myself: a copyright-free version of the favored lighter pic.
It's still based on the copyrighted image though. Whatever the legalities are about that approach, it strikes me as similar to plagiarism from a moral perspective.
