Fair use issues: The Bear

I created this new trope page, The Bear (the opposite of The Twink), and I instantly thought of the perfect image that illustrates the concept — an image by the artist Kazuma that shows a bearish man compared to a bear. However, I also realized that Kazuma does not like his images shared anywhere. He actually stopped publishing online because he says foreigners are untrustworthy thieves, and no longer contacts any non-Japanese people, including people who were previously his friends. He would probably not approve of the image being used as an example here. But also, I wonder...does he have to? Would this be fair use?

If it's not appropriately fair use, the picture may have to be changed.

Also, the examples list is extremely light at the moment. I could do a more thorough sweep through gay fiction for more examples, but I hadn't done that at all yet. Already remembered some as I type though.

While I think we probably could get away with it as Fair Use, I'd say that we should look for others first.

Alright. I'll present some alternative candidates. I know of some on Y Gallery, at least. Warning, some of the community and user icons on that site can be graphically Not Safe for Work, even when a submission is general-rated.

I also know of some artists who draw (the human kind of) bears on Fur Affinity, but it's down at the moment. There is also a whole sea of bear modeling, erotica and porn, and I'm sure there's something worksafe in there somewhere that isn't too inherently sleazy for tvtropes.

And don't worry Madrugada, I haven't forgotten about the Image Pickin' Discussion for Big Beautiful Man. I'm just multitasking. ^_^ The funny thing is, The Bear and Big Beautiful Man can and often do overlap, so a lot of good bear examples would be good chubby examples. But a lot of bears are thin, and a lot of husky hunks are hairless.

Well, this discussion looks to be getting stale, so I might as well drop it for now. I only brought it up because I thought I should be honest about the picture and the attitudes of its artist. But really, no one outside Japan has even heard a peep out of him for a few years now — he won't talk to foreigners, and his website is derelict.

I'd say it's not an issue. By making the images public in the first place, he tacitly agreed to be bound by the copyright laws. By putting them on the web he explicitly acknowledged that they would be seen. Leave it up. Might want to pothole it to his site, just as away of us acknowledging that we do know where it came from.

Sure, I can do that.
