Valve might be possible if they give the okay. Having appearances on a Nintendo system isn't really a necessity.
Why do you guys think Sakurai made the "no anime/non-video game characters" rule? How do you guys think he'd feel if he knew that anime characters are in Super Smash Flash, Super Smash Flash 2, and Super Smash Bros Crusade?
AAAAUUUUGGGHHHH!!!!Probably would either say it's silly or wouldn't care. It's not exactly his game, and he's far more respectful towards other developers than people give him credit for.
Valve would be interesting for character choices. As long as they're notable enough, and can be made to fit(and obviously the companies are okay with it), they're viable.
Shadow?I doubt he'd care too much, given that they're fan games.
Also, I don't think it's so much of a "no anime/manga character" rule as a "video-game characters only" rule. The series as a whole was started as a celebration of gaming, so it makes sense for them to not include non video game characters.

He most likely made the rule to make it so that he didn't get bombarded with requests for every fictional character under the sun. Not that that doesn't stop people from trying.
And yeah, why would he give a shit about a bunch of fan games? Like, he's more likely to have heard of Shovel Knight.

I think a lot of those requests are jokes.
And I think most of those tend to be anime characters.
Though adding anime characters in would be a good troll move at least.
...I feel like my fangame idea goes a bit too overboard with non-game characters. While I have only 6 non-video game franchises represented, most of them have more than 1 fighter representing them.
AAAAUUUUGGGHHHH!!!!Oh sure, you get a lot of joke troll requests of "LOL PLZ ADD GOKU TO SMASH". But then you also get the ~5 minute videos explaining why Goku is totally a valid and reasonable choice and that if every one of your 6-digit-number subscribers voted for him in the Ballot you could prove to Sakurai that he's what Smash truly needs.

I'm not saying that there are those that seriously want Goku in Smash (sorta like me), that's pretty much gonna be a given.

Goku isn't even highest tier in Smash Flash 2. Naruto outranks him in SSF 2 tiers.
I think any anime character is going to receive more backlash than any video game character choice. Goku, Naruto, Ichigo, Luffy, Sailor Moon, and Inu Yasha would get massive backlash.

AAAAUUUUGGGHHHH!!!!I think a lot would have to happen before Rare would agree to let the Battletoads into Smash. I'll admit, crazier things have happened (as a veteran of the 8-bit and 16-bit days, it astounds me that Mario and Sonic have been in multiple games together, and Nintendo sells Sega merchandise in the form of a Sonic statue that does things in Nintendo games). Honestly, I think the Team Fortress 2 characters (I'd guess The Heavy or The Scout, as I think they have the most Smash-friendly movesets) would be more realistic than the 'Toads.
If I had to pick an Ubisoft rep or two... Rayman would be the obvious first choice; I don't think they'd consider offering anyone else first. For a second... well, just imagine how people would react if Jade of Beyond Good & Evil was DLC. Easy to imagine her moveset, and she's be a hugely popular choice for the fanbase.
Commander Video wouldn't really have another rep from the same company - Choice Provisions doesn't have anything else really on the level of Video's prominence. If you wanted another indie developer getting representation... well, Shovel Knight is almost too obvious. What else could make the cut?
Oh, I have an oddball choice from Konami - Light and TwinBee. An anthropomorphic ship that punches things and shoots is far from the wackiest thing that Smash does, and you could have one of its specials vary based on what bell it pulls out. Plus, you could even pull out a special or two based on its appearance in the Parodius! games. About the only downside is that TwinBee is mostly only a Japanese phenomenon. Of course, that didn't stop Fire Emblem characters from appearing in Melee.

That said, if even a fraction of the rumors about Rare's split from Nintendo are true, Valve is still more willing to work with Nintendo than Rare is.

Here's what makes the Battle Toads difficult:
In the miraculous situation that Nintendo and Rare can actually work something out, first choice is most definitely going to be Banjo Kazooie. More than just the notable fan demand, it would be cashing in on the fact that Banjo was considered for Melee but dropped due to the buyout.
So what you have now is one of Battle Toads (most like Rash thanks to Killer Instinct) fist-fighting Conker for the second pick, assuming we even get that far.
The thing is, Rare is completely a shell of its former self, with all of its original employees having moved on to their own projects.
