An infinite is still an infinite. And when it's 100% unbreakable, it's a major problem. I don't mind hard to get out of infinites. I mean, I'd still call them Game Breakers and prefer them banned, but they don't need to be. It's either "ban this move", "ban this character match up(not feasible)", or "ban this character". I don't like bans(not that it isn't always a bad option depending the situation), but what else can they do but hope for a patch? Watching the entire match so nobody uses an infinite is actually kind of difficult. Judges have to keep an eye on a lot.
Shadow?Infinites in fighting games are almost never banned though. Look at the competitive scene for Marvel 3 and how many TAC infinites there are.
The only kinds of glitches that would get banned are ones that force a time-out, like Meta Knight's infinite cape glitch. They could do what the Melee community did with wobbling and make it so you can only use it for a certain length of time, but until it gets fixed it probably won't be banned.
I dunno. From a tourney standpoint - since they're typically one-on-one - it being character specific and a bug might actually make it worse, because it means anyone playing Robin won't have a fair match against anyone playing Samus unless the Samus player can be trusted to restrain themselves.

Perhaps that's one reason why Japan got the 3DS version first. It's a beta, in a sense.

I think it's easy to fix myself. Just change how it works. He said by Friday it'll be finished. So clearly he has to go into the coding and test it out too. It's a major change to how a move works, after all.
...I wonder what her Down B customs are. >_>
