It can also be third party owned and first party developed/published Popeye, Hamtaro: Ham-Hams Unite!. The muddy water is simply a matter of perspective. The consumer is always second. To Nintendo, it is first to the consumer since it owned the arcade cabinets and GBA, if not the characters.
The question on, say, Izuma Eleven or Professor Layton, is how much of them Nintendo own. Geno is considered third party, for instance, despite being in a published Nintendo work about something we all knew Nintendo owned. Squaresoft claimed ownership of practically all the original material it put in (as opposed to its deal with Disney, where Square only really keeps its original property, no Dissidia Sora for you!)

, since this is a 3DS picture. My guess is that was the mistaken part, since they look like their 3DS design.
Also, "The Smash Bros. series doesn't always stay true to scale." Thank you. This doesn't confirm Ridley or anything, but his size can be reduced because Sakurai doesn't think scale is outright necessary to matter in all instances.
