Agnes is Emma
We only see Agnes on the floor with a small pool of blood not moving, it's never established that she's dead. The fall may have resulted in a brain injury that resulted in amnesia. The people at the orphanage covered it up and Agnes became Emma.
The family photo in her apartment of her as a child looks like Agnes.
Neither Simon nor Emma realized it (she doesn't remember and he wouldn't want to).
