It is common knowledge that only Lucky can ride him, so he's knowingly sold a horse that nobody can use as a riding animal. Therefore, he's technically selling defective goods with full knowledge of the defect and thus, the auction house that bought Spirit would be well within their rights to demand their payment back once that fact was discovered.
