Rewrote the legal section again. Stating something which has never had a ruling—nor even seen court at all—to be technically illegal (unlike, say… Emulation, gray market export, or abandonware) is really pretty silly. The contributory infringement link too has no connection with this, since its only possible applicability would be to venues (websites, conventions, catalogs…) that distribute both patchers and pirated goods like ROM dumps at the same time, which has absolutely nothing to do with the legality of the patchers themselves or their own distribution.
Also, the argument that translation patches contain a coherent translated text can be quite specious. In the case of many binary comparison patchers, for instance, it would be legally equivalent to claiming that a PGP key or MD5 checksum of copyrighted data is a derivative work, an argument which has been proven to lack any merit in numerous rulings.
