Also keep in mind that we don't know the exact deals made, TV rights and Film rights don't have to come alongside each other (as the X-men thing shows) and what we have found out about the deal made seems to indicate that it's not that detailed. Remember we've had several character sbecoem shared because it was unclear who had the rights to them, so it's possible that the IP ownership for SWORD was unclear and as nobody wanted to litigate they just decided to share the IP.

Hint: The answer is no but because Marvel couldn't afford a drawn out court case back then, then settled the issue by agreeing that Marvel has the rights but isn't able to do TV shows which ride in the tailcoat of Fox's success. So at least theoretically Marvel can use whoever and whatever they want in their TV shows, but it is not worth to p... off Fox over it, so they have to tread carefully.
Basically, every time Fox or Marvel want to make an X-Men television show, it needs to be a Fox/Marvel co-production. Which is why Legion and The Gifted are also produced by Marvel Television and Jeph Loeb is, technically, in charge of them.
As great as this finale was, I can't help but feel like they missed the opportunity for Ghost Rider Coulson to whip out a flaming cyber hellfist.

You lost!I liked Bobbi and Hunter together. But there is no need to act as if they are joined by the hip either.
Oh no....I never really liked Hunter, but I really despised him in Season 3. He was a total idiot and an outright jerkass there, especially when he suggested that Fitz should just let Will die because he is competition.
And without Bobby interacting with him, the only interesting part about him is gone too. Hopefully he won't rejoin the team full-time.

Regarding SWORD, something to keep in mind is that Fox and Marvel seem to be a lot more willing to swap characters as of late. Ego the Living Planet was originally tied up in the Fantastic Four rights, but they were able to work out a deal. Likewise Fox didn't have the TV rights to the X-men in their original deal, but they've been able to work one out anyways.
So even if SWORD was originally tied into the X-men rights, we are in an era where that in itself doesn't mean we can rule them out.
Another possibility is that there are specific characters affiliated with SWORD that are tied into the X-Men rights, but the organization itself is shared. The Skrulls are in a similar situation where specific Skrull characters are tied in to the Fantastic Four rights, but the Skrulls as a species are shared.
