Marvel was able to publish his adventures under the title "Captain Marvel" because the trademark on the "Shazam" version had lapsed, as all comic books featuring him had been cancelled in the fifties. Mar-Vell is a HumanAlien who went native and defended Earth, until he was KilledOffForReal in the Eighties.
